Public Adjuster vs Attorney

The Adjuster

A public adjuster is a licensed insurance professional who helps homeowners and commercial property owners in case of any type of property damage. We negotiate with the owner’s insurance to try and get what is rightfully owed to them based on the loss and damages. A public adjuster inspects the damages carefully, fully documenting every step of the way. Then, we calculate an estimate based on the costs of the damages. Afterwords, we submit this estimate to the insurance and finally, we fight to get the maximum settlement amount for the property owner.

The Attorney

An attorney at law or attorney-at-law is defined as a practitioner in a court of law who is legally qualified to prosecute and defend actions in such court on the retainer of clients. An attorney actually practices law in court whereas a lawyer may or may not. An attorney has passed the bar exam and has been approved to practice law in his/her jurisdiction. A property damage attorney can sue the property insurance when the claim has either been denied or underpaid.

What is the Difference?

It is crucial to hire a public adjuster when dealing with property damage. A public adjuster is a licensed professional who understands insurance policies and laws. In most cases, a public adjuster will reach a settled payout from the proposed claim. If the property owner’s insurance denies the claim, we can either reopen the claim, go to mediation or do an appraisal. If we try all of these steps and still cannot reach an agreement with the insurance, only then will we hire an attorney. An attorney will then sue the property owner’s insurance to try and reach a settlement.

What is the Benefit?

When dealing with property damage, a public adjuster, instead of an attorney, may save you time and money. A public adjuster can represent or reopen a claim with the information and delicacy needed to maximize your payout. 90% of our claims are negotiated and settled with the insurance, before we ever have to get an attorney involved. The insurance then has 90 days to either pay, underpay or deny the claim. An attorney is only necessary when you want to sue the insurance company for the denied or underpaid claim. A lawsuit with your insurance company may serve as a headache. Suing such large corporations may require you to attend depositions, subpoenas and more, and may take up to 1-2 years just to finalize. When dealing with a public adjuster, you can sit tight, and let us handle the entire process and maximize your payout.
